  • Package – Bundled services with defined benefits and limitations
  • Credits – The currency system Clients use to access platform features
  • Content – All information, materials, and data available on or through the platform
  • Profile – Candidate's assessment results, skills, experience, and qualifications
  • Assessment – Tests, games, and evaluations measuring candidate skills and aptitudes

2.3 Account Creation and Access

Eligibility

You must be at least 18 years old and legally capable of entering into binding contracts to use Jobful.

Registration Requirements

For Candidates:

  • Valid email address
  • Accurate personal information
  • Honest representation of skills and experience

For Clients (Employers):

  • Company Tax Registration Code
  • Business email address
  • Bank account details for billing
  • Authority to represent your organization

Account Validation

Your account activates only after you:

  • Confirm your email address
  • Provide all required information

Account Security

You're responsible for:

2.5 Pricing and Payment

Credit System

Clients purchase services using credits. Each service or package has a defined credit value.

  • Credit packages are priced in Euro (EUR) and include VAT
  • Credit validity: 12 months from purchase date
  • Non-refundable: Unused credits expire and aren't refundable

Billing

  • Invoices are issued electronically and added to your account
  • Payment terms are specified in each order
  • Currency conversion (if applicable) uses the National Bank of Romania exchange rate on the invoice date

Payment Methods

  • Bank transfer
  • Online payment (when available)
  • Other methods as displayed during checkout

Your Responsibilities

  • Provide accurate billing information

Late Payment

Failure to pay on time may result in:

Candidate Access Rights

As an employer, you may access candidate profiles only when:

  • The candidate has given explicit consent
  • You're using information for legitimate recruitment purposes
  • You comply with data protection laws

Recruitment Use Only

You agree to use the platform exclusively for recruiting candidates for:

  • Employment opportunities
  • Legitimate collaboration arrangements
  • Actual open positions

Material Requirements

You must provide:

  • Company logo and branding materials
  • Accurate company description
  • Organizational values and culture information
  • Benefits offered to candidates

You confirm you own or have licenses for all materials provided.

Non-Recruitment Clause

For the duration of these Terms and 3 years after termination, you will not:

  • Solicit Jobful employees, contractors, or service providers
  • Attempt to hire anyone who worked on Jobful's development or marketing
  • Induce Jobful personnel to terminate their relationships with us

Non-Competition Clause

For the duration of these Terms and 3 years after termination, you will not:

  • Replicate or copy the Jobful gamification system or platform concept
  • Provide competing services of the same nature as Jobful
  • Carry out competitive activities against Jobful

These restrictions also apply to your representatives, associates, administrators, employees, and affiliates.

Violations and Liability

Breaching the non-recruitment or non-competition clauses makes you directly liable for:

  • All damages suffered by Jobful
  • Lost profits and business opportunities
  • Legal costs and reasonable attorney's fees

2.9 Candidate-Specific Terms

Profile Accuracy

You're responsible for ensuring your profile information is:

  • Accurate and truthful
  • Current and up to date
  • Complete to the best of your ability

Assessment Participation

When you participate in assessments:

  • Results reflect your genuine abilities
  • You complete them honestly without assistance
  • You understand results may be shared with employers (with your consent)

Consent to Data Sharing

You control whether employers can see your profile. When you consent:

  • Employers can view your assessment results and profile
  • They become independent data controllers of your information
  • Their privacy policies govern how they use your data

You can withdraw consent anytime, though this doesn't affect data already shared.

2.10 Confidentiality

Mutual Confidentiality

Both parties agree to maintain confidentiality of:

  • Information exchanged through the platform
  • Business operations and strategies
  • Proprietary data and trade secrets
  • Any non-public information

Exceptions

Confidentiality obligations don't apply when:

  • Information is already publicly available

When we use subcontractors, they're responsible for fulfilling their obligations directly.

You may not assign or transfer your account or these Terms without our written consent.

2.14 Limitation of Liability

Liability Cap

To the maximum extent permitted by law, our total liability for any claim arising from these Terms or your use of Jobful is limited to the fees you paid in the 12 months before the claim arose.

Excluded Damages

We're not liable for:

  • Indirect, incidental, or consequential damages
  • Loss of profits, revenue, or business opportunities
  • Loss of data (beyond our statutory obligations)
  • Reputational damage
  • Costs of substitute services

Exceptions

Nothing in these Terms limits liability for:

Your Indemnification

2.15 Force Majeure

Neither party is liable for failure to perform obligations due to events beyond reasonable control, including:

  • Pandemics or public health emergencies
  • Internet or telecommunications failures
  • Cyber attacks or data breaches

If force majeure continues for more than 3 months, either party may terminate these Terms without penalty.

Governing Law

These Terms are governed by the laws of Romania, without regard to conflict of law principles.

Jurisdiction

Any disputes will be resolved exclusively by the competent courts in Bucharest, Romania (the jurisdiction of Jobful's headquarters).

You expressly accept this territorial jurisdiction.

Amicable Resolution

Before initiating legal proceedings, parties agree to attempt good-faith negotiations for 30 days.

Costs

The losing party in any dispute pays:

  • All court costs and legal fees
  • Reasonable attorney's fees
  • Enforcement costs
  • Other expenses as determined by the court

2.17 General Provisions

Entire Agreement

These Terms, together with our Privacy Policy and Cookie Policy, constitute the entire agreement between you and Jobful.

Amendments

We may modify these Terms at any time. Changes become effective when:

  • Posted on the platform with a new "Last Updated" date
  • You continue using Jobful after changes are posted

We'll notify you of significant changes via email or prominent platform notice.

Severability

If any provision is found invalid or unenforceable, that provision is severed and the remaining Terms continue in full effect. We'll replace invalid provisions with similar valid ones.

No Waiver
